CNIPA’s Decision to Maintain Asahi Kasei’s Chinese Patent on Separator for Lithium Ion Secondary Battery

On July 9, 2019, the CNIPA (China National Intellectual Property Administration) made a decision to maintain the Chinese patent (No. ZL200680046997.8, hereinafter "Disputed Patent") owned by Asahi Kasei Corporation (Headquarters: Chiyoda-ku, Tokyo; President: Hideki Kobori; hereinafter "Asahi Kasei") in the patent invalidation petition case.*

Asahi Kasei filed a patent infringement lawsuit on August 13, 2018, based on the Disputed Patent in the Shenzhen Intermediate People's Court against Shenzhen Xu Ran (旭冉) Electronic Co., Ltd. and Shenzhen Xu Ran (旭然) Electronic Co., Ltd. as joint defendants (hereinafter "Xu Ran Electronic and Others"), both sellers of separators for lithium ion secondary battery in Shenzhen, China, requiring Xu Ran Electronic and Others to stop selling "single-layer W-scope" battery separators in China and compensate from the same for related losses. This patent invalidation petition case was filed by Shenzhen Xu Ran (旭冉) Electronic Co., Ltd. on December 21, 2018, against the Disputed Patent.
